When Should a Transfer Impact Assessment be Conducted?

The processing of data in unsafe third countries is subject to strict requirements. For example, if processors in the USA are to be used, the new EU standard contractual clauses require a risk assessment of the data transfer in the specific individual case (transfer impact assessment).

The main objective here is to identify and assess the risks of data being disclosed in contravention of EU law (e.g., by intelligence services). A transfer impact assessment can also be used to determine additional protective measures that are needed to transfer data to an unsafe third country due to the conflicting legal situation.
